Our Consumer Health Data Privacy Policy Has Recently Changed.

Your privacy is important to Homethrive, Inc. (“Homethrive,” “we,” “us,” or “our”). This Consumer Health Data Privacy Policy applies to “Consumer Health Data”, as that term has been defined by applicable laws, and only as related to your use of our Website. Capitalized terms used but not otherwise defined herein shall have the meanings afforded to them in applicable Consumer Health Data privacy laws, our Privacy Policy, or our Terms and Conditions.  This Consumer Health Data Privacy Policy does not apply to information collected through any other means, including on any other website operated by a Third Party.

1. The Categories of Consumer Health Data We Collect and How We Use Them.

We Collect the below categories of Consumer Health Data from Consumers.

• Individual health conditions, treatment, diseases, or diagnosis;
• Social, psychological, behavioral, and medical interventions;
• Health-related surgeries or procedures;
• Use or purchase of prescribed medication;
• Bodily functions, vital signs, symptoms, or measurements related to health;
• Diagnoses or diagnostic testing, treatment, or medication;
• Gender-affirming care information;
• Reproductive or sexual health information;
• Biometric data;
• Genetic data;
• Precise location information that could reasonably indicate a Consumer’s attempt to acquire or receive health services or supplies;
• Data that identifies a Consumer seeking health care services;
• Health-related data that have been derived or inferred from the above.

Examples of Consumer Health Data we may collect include caregiving needs, health conditions or diagnoses shared by you, medication-related information, care preferences, service needs, and other health-related information you choose to provide in connection with Homethrive services.

We use the above-mentioned categories of Consumer Health Data for the following purposes.  To:

• Provide our Website and its contents to you;
• Provide, manage, analyze or improve the services requested by you, including in the context of your business relationship with us, and perform our contractual obligations;
• Fulfill or meet the reason you provided the information (e.g., to respond to your email or request for information);
• Process payments for our products and services;
• Analyze and better understand your needs, preferences, and interests;
• Conduct internal business analysis and research;
• Advertise and promote our products and services;
• Coordinate with vendors, service providers, and third parties as needed to provide, administer, support, secure, or improve the services requested by you;

We may also aggregate, de-identify, or otherwise anonymize Consumer Health Data and analyze such data for statistical or any other purposes permitted by law.

• Information We Collect Directly From You.  We may collect Consumer Health Data that you provide to us when you use our Website or interact with us. For example, we may collect information when you browse through the Website, register or create an account, make an information request, or when you otherwise communicate or interact with us and provide your information via our Website or other communication channels.

• Information We Automatically Collect About You.  As with many websites, when you interact with our Website, we may use automatic data collection technologies to collect and log certain information that may constitute Consumer Health Data about your equipment, browsing actions, and patterns, including details of your visits to our Website (e.g., traffic data, logs, other communication data, and resources that you access and use on our Website), information about your computer, mobile device, and internet connection (including your IP address, operating system, and browser type), and location data, which we collect to ensure you reside in a jurisdiction in which you are eligible for using our Website, to comply with relevant laws, and for fraud prevention purposes.

• Cookies. We may collect Consumer Health Data about your from technologies we use for automatic data collection including browser cookies, flash cookies, and web beacons.

• Information We Collect From Other Sources. We may collect Consumer Health Data about you from our Affiliates and our partners and their service providers and contractors. We also may obtain information you have made publicly available, including from websites and online services you use, consumer research platforms, and/or business contact databases.

We may also draw inferences from the information we collect from and about you.

3. The Categories of Consumer Health Data that We Disclose.

We may disclose the categories of Consumer Health Data described in Section 1 to the categories of third parties and affiliates described below, only as permitted by applicable law and for the purposes described in this Consumer Health Data Privacy Policy.

4. Third Parties and Affiliates with Whom We Disclose Consumer Health Data.

We Disclose Consumer Health Data with the following Third Parties and Affiliates:

• With companies and vendors that perform services for us, including data hosting vendors, customer support providers, payment processors, information technology support providers, email service providers, marketing and analytics providers, and other service providers;
• To accountants, auditors, lawyers, and other outside professional advisors to Homethrive, subject to appropriate contractual obligations of confidentiality;
• Where required by law, court order, or subpoena if we believe disclosure is in accordance with, or required by, applicable law or legal process or where necessary to prevent, detect, or prosecute criminal offenses, or to protect the rights, property, and safety of Homethrive or others;
• In connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company;
• Between and among Homethrive and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
• At your direction or with your consent.

We may also process and may disclose information to Third Parties and Affiliates if the information has been de-identified, aggregated, or otherwise anonymized in a way so it cannot be used to identify you.

We may be required to disclose Consumer Health Data in a limited number of situations where the law or our professional rules require us to act. For additional information, please refer to our Privacy Notice.

5. How to Exercise Your Rights With Respect to Your Consumer Health Data.

Applicable law provides eligible Consumers with specific rights regarding their Consumer Health Data. We do not sell or share Consumer Health Data, as those terms are defined under applicable consumer health data privacy laws. This section describes these rights and how to exercise them:

• Right to Confirm/Access:  You have the right to confirm whether we Collect or Disclose your Consumer Health Data, and to access such Consumer Health Data, including a list of all Third Parties and Affiliates with whom we have Disclosed such data and their applicable contact information.

• Right to Withdraw Consent:  You have the right to withdraw consent from our Collection or Disclosing of your Consumer Health Data, as applicable.

• Right to Delete:  You have the right to request that we delete Consumer Health Data you have provided to us or that we otherwise obtained about you.

6. Changes to this Consumer Health Data Privacy Policy.

This Consumer Health Data Privacy Policy is effective as of the date stated at the top of this Consumer Health Data Privacy Policy. We may change this Consumer Health Data Privacy Policy from time to time. Your access of the Website after such change will be deemed acceptance of the new Consumer Health Data Privacy Policy.

Supplement to Consumer Health Data Privacy Policy for Nevada Consumers

This Supplement to Consumer Health Data Privacy Policy for Nevada Consumers (this “Supplement”) applies to Nevada Consumers for purposes of providing additional disclosures required by Nevada’s Consumer Health Data privacy law, including the rights that may be available to Nevada Consumers. It supplements the Consumer Health Data Privacy Policy and applies solely to information or practices that are subject to Nevada’s Consumer Health Data privacy law.  Capitalized terms used but not otherwise defined herein shall have the meanings afforded to them in applicable Consumer Health Data privacy laws, our Privacy Policy, or our Terms and Conditions.

Collection, Use, and Processing of Consumer Health Data. We Collect, Use, Process, and Disclose Consumer Health Data for the purposes and in the manners described in Section 1and Section 2of our Consumer Health Data Privacy Policy.

Disclosure of Consumer Health Data.  We may disclose your Consumer Health Data in the manner and for the purposes described in Section 1 of the Consumer Health Data Privacy Policy with the categories of Third Parties and Affiliates described in Section 4of our Consumer Health Data Privacy Policy.

Exercising Your Privacy Rights and Review & Revision of Your Consumer Health Data. Applicable law provides eligible Consumers with specific rights regarding their Consumer Health Data.  For a description of these rights, as well as instructions on how to exercise them, refer to Section 5 of our Consumer Health Data Privacy Policy.  If you would like to review and/or revise your Consumer Health Data, you may submit a request to us via any of the methods listed in Section 5 of our Consumer Health Data Privacy Policy. We will respond to your requests to exercise your rights in accordance with applicable law, but in any case no later than 45 days after receiving your request. We may extend this period up to 45 days only where doing so is permitted under applicable law.

Changes to this Supplement. From time to time, we may change this Supplement.  We will notify you in the same manner as set forth in Section 6 of the Consumer Health Privacy Policy.  Your access to and/or use of the Website after such change will be deemed acceptance of the new Supplement.

Third Party Collection of Consumer Health Data. Please note that some Third Parties may collect Consumer Health Data about you over time and across different websites or online services you may visit.  This collection of Consumer Health Data by Third Parties is unrelated to our Collection of Consumer Health Data from you, and we encourage you to view those Third Parties’ privacy notices for more information.
